Moda Seating Policies

Thank you for shopping with Moda Seating. Please review the policies below before placing your order. These terms are designed to help customers understand our shipping, delivery, freight claim, return, cancellation, product variation, and general order policies.

By placing an order with Moda Seating, you acknowledge and agree to the policies outlined below.


1. Shipping & Freight Delivery Policy

Moda Seating works to provide cost-effective freight shipping options for commercial furniture orders. Most orders ship by freight carrier due to the size, weight, and packaging requirements of commercial-grade furniture.

Standard shipping quotes are based on delivery to a commercial address and do not include additional freight services unless specifically requested or required. If the customer does not request or approve any additional freight service before shipment, and the carrier later determines that an additional service is required, any related freight charge will be the customer’s responsibility.

Standard Curbside Delivery

Standard freight delivery is curbside delivery to a commercial address. The driver will deliver the shipment to the nearest accessible delivery area. Drivers are not required to bring products inside, unpack items, or assist with unloading unless special arrangements have been made in advance.

Customers are responsible for being present at the delivery location and unloading the freight from the truck within the carrier’s allowed delivery time, generally within 30 minutes of arrival.

If the delivery location does not have a loading dock, we strongly recommend requesting lift gate service.

Customer-Arranged Freight Pickup

Customers may choose to use their own freight carrier to pick up an order from our warehouse. When a customer uses their own carrier or third-party transportation provider, Moda Seating is not responsible for freight-related issues, delays, damages, missing items, or carrier claims after the shipment is released.


2. Additional Freight Services

The following services may be available in most cases for an additional charge. These services must be requested before shipment whenever possible.

Lift Gate Service

Lift gate service is recommended for commercial locations without a loading dock. A lift gate truck uses a mechanical platform to lower freight from the truck to the ground, helping reduce the difficulty of unloading and the possibility of damage.

Limited Access Delivery

Limited access service may be required when a full-size freight truck cannot easily access the delivery location or designated unloading area. This may also include high-traffic areas, congested streets, restricted delivery zones, or locations where access is difficult for a standard freight truck.

Limited Delivery Time

Limited delivery time fees may apply when the customer is only available to receive delivery during a specific date or time window.

Re-Delivery

A re-delivery fee may apply if the carrier attempts delivery but is unable to complete it due to incorrect delivery information, incomplete instructions, or the customer not being present to receive the shipment.

Re-Consignment

A re-consignment fee may apply if the customer changes the delivery address after the shipment is already in transit.

Residential Delivery

Residential delivery fees apply when delivering to a residential address. To avoid this fee, customers should arrange delivery to a commercial address whenever possible.


3. Delivery Inspection Requirements

All furniture is inspected before shipment to help ensure that damaged items or items with missing parts are not knowingly shipped.

Once a freight carrier takes possession of the shipment, the carrier becomes responsible for the condition of the shipment while in transit. All common carrier deliveries require a signature upon delivery.

Customers must inspect the shipment before signing the Bill of Lading and/or Delivery Receipt.

Before Signing for Delivery

Please check for visible damage, shortage, or signs of mishandling, including but not limited to:

  • Torn or broken shrink wrap

  • Forklift punctures

  • Crushed cartons

  • Missing cartons or cases

  • Broken pallets

  • Open or damaged packaging

If visible damage is found, ask the driver to allow inspection of the cartons and contents before accepting the shipment.

If any damage is found, write the following clearly on the Bill of Lading and/or Delivery Receipt:

“Damaged on Delivery.”

If You Cannot Fully Inspect the Shipment Immediately

If you are unable to fully inspect the boxes at the time of delivery, write the following on the Bill of Lading and/or Delivery Receipt before signing:

“Pallets are subject to inspection at time of delivery. Customer will notify carrier of any pending damage within 24 hours.”

This helps document that the shipment still requires inspection after delivery.

Important Delivery Notice

If damage, shortage, or incorrect items are not noted on the Bill of Lading and/or Delivery Receipt before signing, the shipment may be considered accepted in good condition. Freight carriers may deny claims that are not properly documented at delivery. Moda Seating is not responsible for claims denied due to missing or incomplete delivery notes.


4. Damages, Shortages & Freight Claims

Customers must report freight damage, shortages, or delivery issues to Moda Seating on the same day the shipment is delivered.

Photos and/or videos are required when reporting damage or filing a freight claim. Customers must keep the original pallets, cartons, packaging, and packing materials for possible carrier inspection.

Customer Responsibility for Freight Claims

Because Moda Seating sells furniture products and arranges freight service on the customer’s behalf, customers are responsible for freight-related claims directly with the carrier when products are damaged in transit.

Moda Seating will gladly assist by providing guidance and documentation where possible, but Moda Seating is not responsible for damages caused during transit once the carrier has taken possession of the shipment.

Failure to report freight damage promptly, provide photos or videos, or keep original packaging may result in denial of a claim.

Replacement or Refund for Damaged Items

If an order includes multiple items and one or more items are damaged, Moda Seating reserves the right, at its sole discretion, to either replace the damaged item or issue a refund for the damaged item only.

A refund or replacement for the affected item will be considered full resolution of that item. The customer may not claim that the entire order was unfulfilled or improperly fulfilled because one or more damaged items were refunded instead of replaced.

If a replacement item is unavailable, out of stock, discontinued, or does not have a confirmed ETA, Moda Seating may issue a refund for the affected item instead of providing a replacement.


5. Returns & Exchanges

Customer satisfaction is important to us. We will make every effort to assist with return or exchange requests; however, all returns and exchanges are subject to manufacturer policies and Moda Seating approval.

Customers must contact Moda Seating before returning any item. Items returned without prior authorization will not be accepted, refunded, or exchanged.

Return Conditions

To be eligible for return consideration:

  • Items must be unused

  • Items must be unassembled

  • Items must be returned in the original packaging

  • Items must be approved for return in advance

  • Items must pass inspection upon arrival

Used or assembled items cannot be returned or exchanged.

Returns will not be accepted without original packaging.

Defective or Incorrect Products

If Moda Seating ships a defective product or incorrect product by mistake, we may issue a refund for the product cost or assist with a replacement, provided that the item is unused, unassembled, and returned in its original packaging.

Original shipping charges are not refundable unless otherwise approved by Moda Seating.

Customer Preference Returns

If a product is not suitable for the customer and Moda Seating agrees to accept the return, original shipping charges will not be refunded. The customer is responsible for arranging and paying return shipping.

Returned products are subject to inspection. If a returned product arrives damaged, used, assembled, missing parts, or not in acceptable condition, the customer may be charged the full product price as shown on the original order.


6. Restocking Fees & Refused Shipments

A 50% restocking fee may apply to returned orders when the return is not due to an error by Moda Seating.

A 50% restocking fee may also apply if a customer refuses delivery of a shipment when the products are not damaged. In that case, the customer is responsible for both the original shipping cost and the return shipping cost.


7. Non-Returnable Items

The following items are not eligible for return unless Moda Seating is at fault:

  • Custom-made items

  • Special-order items

  • Clearance items

  • Discontinued items

  • Used or assembled items

  • Items without original packaging

  • Items damaged after delivery or during return shipping


8. Cancellation Policy

Once an order is finalized—either through an online order, invoice approval, or signed estimate—it is processed immediately. Many of our products require specific assembly, packaging, preparation, or allocation to the customer’s order.

Cancellation Before Shipping

Orders cancelled after finalization but before shipping may be subject to a 50% restocking fee.

Cancellation After Shipment

If an order has already shipped, the original shipping cost is non-refundable. Return freight, handling fees, and restocking fees may apply. These fees may apply once the carrier takes possession of the shipment, even if the order has not yet arrived at the customer’s location.


9. Sample Approval for Large Orders

For larger orders, including more than 24 chairs or more than 12 tables, Moda Seating strongly recommends purchasing a sample before placing the full order.

If the customer chooses not to order a sample, the customer accepts the product based on the information, images, descriptions, and specifications provided. Claims regarding size, quality, comfort, durability, appearance, or expectations that could have been reviewed through a sample may not be accepted.


10. Custom-Made Furniture & Product Variations

Many Moda Seating products are custom-made or prepared according to order requirements. Slight differences in size, shape, finish, texture, upholstery, or construction may occur.

Small variations are normal in commercial and custom furniture and are accepted by the customer when placing an order.

Re-orders may come from a different production batch, which may result in differences in finish, size, texture, or color. Customers are responsible for accepting reasonable product and batch variations.


11. Color, Texture, Finish & Size Disclaimer

Product colors, stains, textures, grains, upholstery materials, and finishes may appear differently on screens due to variations in monitors, browsers, lighting, photography, and display settings.

Moda Seating cannot guarantee that the appearance of a product on a screen will be an exact match to the finished product.

Natural wood products may have variations in grain, tone, texture, pattern, and color. These variations are normal and cannot be fully controlled, even when a sample is provided.

When placing an order without viewing physical samples or products in person, the customer accepts the limitations of online images and digital product displays.

Customers who require more accurate material review should request available samples, including wood finishes, vinyls, fabrics, metal finishes, and other swatches, before approving an order.


12. Re-Orders & Batch Differences

Color and finish options may change from time to time. When re-ordering, customers should confirm the exact color, finish, fabric, stain, and product specifications before placing the order.

Moda Seating is not responsible for mismatches between previous orders and new orders. Re-ordered products may come from a different batch, and finish or material variations may occur.


13. Proper Use, Weight Limits & Inspection

All Moda Seating furniture must be used only for its intended purpose and in a normal, safe, and appropriate manner. Furniture must not be misused, overloaded, stacked with excessive weight, altered, or used for any purpose other than its intended seating or table use.

Unless a product is specifically described as suitable for outdoor use, all products are intended for indoor use only in a normal indoor climate. Use in outdoor areas, uncontrolled temperatures, moisture, or improper environments may void any warranty or liability coverage.

Standard chairs and bar stools are recommended for normal use up to 250 lbs. Customers requiring products for higher weight capacity must contact Moda Seating before purchase to confirm whether the product is suitable for their needs.

Customers are responsible for performing regular inspections, including at least one detailed yearly inspection, to ensure all products remain in safe and acceptable condition for use. Failure to inspect, maintain, or use products properly may void warranty coverage and release Moda Seating from liability related to misuse, improper maintenance, or unsafe conditions.


14. Payment Policy

Customers are required to pay in full before an order is processed.

Moda Seating accepts wire transfers, major credit cards, and checks. If paying by check, please allow approximately 7–10 business days for the check to clear before the order is processed.


15. Minimum Order Policy

All orders must exceed $1,000.00, not including tax or freight.

Orders that do not meet the minimum order amount may be subject to a $130.00 small order charge.


16. State, City & Code Requirements

Moda Seating is not responsible for determining whether products meet specific state, city, local, project, or industry requirements unless those requirements are clearly provided in writing before the order is placed.

Any required specifications, standards, fire ratings, compliance needs, or project requirements must be communicated at the time of ordering.

Products are not guaranteed to meet any specific state, city, fire rating, code, or other requirement unless confirmed in writing by Moda Seating before purchase.


17. Product Descriptions, Specifications & Availability

Product descriptions, names, images, specifications, weights, and dimensions are provided for general informational and marketing purposes.

All weights and dimensions are approximate. Designs, materials, specifications, availability, and pricing are subject to change without prior notice. Products or materials may be discontinued at any time.

Moda Seating is not responsible for customer reliance on product names, descriptions, images, or marketing wording beyond the confirmed details provided in the order documentation.


18. California Proposition 65 Notice

WARNING: Some products can expose you to chemicals, including Chromium, which is known to the State of California to cause cancer. For more information, visit www.P65Warnings.ca.gov.

Customers are responsible for determining whether their finished consumer product requires labeling or other compliance steps under California Proposition 65.


19. Limitation of Liability

Prices are subject to change without notice, including after an order is placed, unless otherwise confirmed in writing by Moda Seating.

Moda Seating will not be liable for any indirect, incidental, special, consequential, punitive, extraordinary, or economic damages, including loss of revenue, profits, data, or business advantage, whether arising from use of the website, purchase of products, shipping issues, product handling, or any related matter.

Moda Seating is not responsible for damages resulting from displaying, copying, downloading, or using website materials.


20. Legal Jurisdiction

Any legal proceedings directly or indirectly arising out of or relating to this website, products, orders, purchases, or transactions with Moda Seating shall be handled in the state or federal courts located in New York.


21. Customer Feedback
